Alexei Nesterenko, Managing Partner of FBK Legal, Moderates Forbes Tax Debate

Alexei Nesterenko has participated in Forbes Tax Debate by moderating the session titled “Is the Tax Clause a Tool to Guarantee Reimbursement of Tax Losses or an Illusion that Creates a False Sense of Security for the Taxpayer?”

“The tax clause is, first of all, a legal mechanism that provides an opportunity to transfer the obligation to reimburse tax losses to an unscrupulous counterparty. But if you look at it somewhat more broadly, it constitutes, firstly, representations of circumstances, confirmation by the counterparty that it has the necessary resources to execute the contract. Secondly, this is a way to disclose the counterparty's tax secrecy and transparency. Thirdly, it is a mechanism of loss compensation. Only with such a comprehensive approach to tax clause assessment it becomes possible to draw a clear conclusion about its pros and cons,” said Alexei Nesterenko.

Tax Debate organised by Forbes is a new format that allows for an interactive discussion of controversial tax law matters, which are often interpreted by the professional community completely differently.
