FBK Legal at CCI’s All-Russian Tax Forum

FBK Legal’s lawyers have participated in the Fourteenth All-Russian Tax Forum held by the Chamber of Commerce and Industry.            

FBK Legal's Senior Expert of Tax Consulting Practice Alesya Homich spoke at the round table titled “Relevant Issues of Indirect Taxation” about difficulties that taxpayers will face following an increase in the VAT rate starting from the next year, “Law No. 303-FZ does not contain any transitional provisions that would explain how VAT is applied in respect of contracts signed before 1 January 2019, which causes a lot of questions and makes supervisory bodies publish explanations that do not provide responses to such questions, but rather aggravate the situation”.

Among the most acute issues she mentioned the need to make amendments to contracts that continue to be valid after the change in the VAT rate and VAT calculation in cases when advance payments are received in 2018 but services under the contract are provided in 2019.

In his turn, FBK Legal’s Senior Expert of Tax Consulting Practice Alexey Yarzutkin spoke about the initiative of the parties to the Charter in the Sphere of Circulation of Agricultural Products to create a special information resource. It will contain a list of entities in respect of which there are indications of unverified source of tax benefits, namely VAT refunds. 

“Such information resource will aim to promote fair competition in agriculture by improving tax discipline among market players and will lead to more responsible self-regulation of the market,” he says.

Many other sessions were held as part of the Forum to address such issues as transfer pricing, tax risk management, indirect taxation, tax disputes, communication with tax authorities etc.

The Forum has become an open platform where lawyers, public officials and businessmen can discuss important tax-related issues, identify gaps in the legislation using common efforts and agree on how to interpret the law.
