FBK Legal Manages to Cancel Procurement and Protect Client’s Interests in Competitive Struggle

Our client — an official distributor of Korean medical equipment — faced unfair competition when bidding in a tender announced by a state healthcare institution of Ivanovo.

FBK Legal’s lawyers managed to prove that the tender documents had been drawn up in such a way that only goods produced by the particular manufacturer met its requirements, which was unacceptable.

When drafting a complaint, the lawyers collected evidence that the competitive supplier had taken part in the preparation of the tender documentation, the tender documentation had been drawn up for the specific manufacturer and contained additional unnecessarily detailed technical characteristics, which restricted competition in procurement for state and municipal needs.

As a result, the Office of the Federal Antimonopoly Service of the Ivanovo Region concluded that the tender documents had been prepared in violation of the regulations and that a new tender should have been arranged after eliminating the violations.
